These Terms and Conditions ("Terms") govern your use of the Orozco HVAC Solutions LLC website and all HVAC services provided by Orozco HVAC Solutions LLC ("Company," "we," "us," or "our"), a limited liability company organized under the laws of the State of California, with its principal place of business at 8704 Burnt Ridge Dr, Bakersfield, CA 93306.
By contacting us for service, scheduling an appointment, accepting an estimate, or using our website, you agree to be bound by these Terms. Please read them carefully before proceeding.
1. Acceptance of Terms
Your use of our website or engagement of our HVAC services constitutes your full acceptance of these Terms and Conditions. These Terms apply to all customers, website visitors, and any person or entity that requests, schedules, or receives HVAC services from Orozco HVAC Solutions LLC. If you do not agree to these Terms, you may not use our website or engage our services. We reserve the right to modify these Terms at any time, and continued use of our services following any modification constitutes acceptance of the revised Terms.
2. HVAC Services
Orozco HVAC Solutions LLC provides heating, ventilation, and air conditioning services including but not limited to:
- Diagnostic service calls and system inspections
- Air conditioning repair and maintenance
- Heating system repair and maintenance
- HVAC system installation and replacement
- Preventive maintenance agreements
- Indoor air quality product installation
- Thermostat installation and programming
- Ductwork inspection and repair
- Emergency HVAC service
All services are performed by qualified technicians in accordance with applicable California contractor licensing requirements, manufacturer specifications, and industry best practices. We reserve the right to decline service in situations that present safety risks, are outside our service area, or are beyond our scope of expertise.
3. Scheduling and Appointments
Service appointments are scheduled based on technician availability and are confirmed by telephone or email. The following scheduling terms apply:
- Appointment windows are provided as estimates and are not guaranteed arrival times. Traffic, prior job complexity, and other factors may affect arrival time.
- We will make reasonable efforts to notify you if we will be significantly delayed beyond the scheduled window.
- You or an authorized adult representative (18 years or older) must be present at the service location for the duration of the service call.
- If no authorized adult is present upon technician arrival, the appointment may be rescheduled and a trip charge may apply.
- Emergency service requests are prioritized based on safety risk and equipment failure severity.
To cancel or reschedule an appointment, please contact us at least 24 hours in advance at (661) 865-1177. Late cancellations or no-shows may result in a cancellation fee as described in our Refund Policy.
4. Estimates and Pricing
We provide written estimates for repair and installation work before any work is performed, subject to the following terms:
- Estimates are based on the technician's assessment of the visible and accessible components of your HVAC system at the time of the diagnostic visit.
- Estimates may be revised if additional problems are discovered once repair work begins that were not apparent during the initial inspection.
- We will notify you of any additional costs discovered during repair and obtain your approval before proceeding with work beyond the original estimate.
- Diagnostic service call fees are charged for the technician's time and expertise in diagnosing your system and are separate from repair costs.
- Free estimates are available for installation and replacement projects. Diagnostic fees apply to repair service calls.
5. Payment Terms
Payment is due upon completion of service unless other arrangements have been made in advance and in writing. The following payment terms apply:
- We accept cash, personal check, and major credit cards.
- For large installation or replacement projects, a deposit may be required prior to scheduling and equipment ordering. Deposit amounts will be specified in the written estimate.
- Returned checks are subject to a returned check fee in addition to the original invoice amount.
- Invoices not paid within 30 days of the service date may be subject to a late payment fee.
- In the event of non-payment, we reserve the right to pursue collection through all available legal means, including filing a mechanic's lien on the property where services were performed, as permitted by California law.
6. Equipment and Materials
When we supply equipment, parts, or materials as part of a service or installation, the following terms apply:
- All equipment and materials supplied by Orozco HVAC Solutions remain our property until payment is received in full.
- Equipment is ordered specifically for your project and may not be returnable to the supplier once ordered. Cancellation of equipment orders may result in restocking fees as described in our Refund Policy.
- We select equipment based on our professional assessment of your needs, site conditions, and applicable codes. The customer is responsible for providing accurate information about their property and usage requirements.
- We are not responsible for equipment failures caused by pre-existing conditions, customer modifications, improper use, power surges, or events outside our control.
7. Warranties
We stand behind our work and provide the following warranty coverage:
- Labor warranty: We warrant our labor for 30 days from the date of service. If a repair fails due to our workmanship within 30 days, we will return and correct it at no additional labor charge.
- Parts warranty: Replacement parts are covered by the manufacturer's warranty, which varies by part and manufacturer. We will assist you in processing parts warranty claims.
- Installation warranty: New equipment installations include a 1-year labor warranty on our installation workmanship. Equipment manufacturer warranties apply separately and may extend for 5–10 years or longer with proper registration.
Warranties are void if the equipment or repaired system is modified, improperly maintained, damaged by misuse or neglect, serviced by an unauthorized technician, or damaged by events outside our control including floods, fires, lightning, and power surges.
8. Website Usage
Your use of the Orozco HVAC Solutions website is subject to the following terms:
- The content on our website is provided for informational purposes only and does not constitute professional HVAC advice specific to your situation.
- You may not copy, reproduce, distribute, or create derivative works from our website content without our express written permission.
- You may not use our website in any manner that could damage, disable, overburden, or impair our servers or network infrastructure.
- You may not attempt to gain unauthorized access to any portion of our website or any systems or networks connected to our website.
- We reserve the right to modify, suspend, or discontinue any aspect of our website at any time without notice.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Orozco HVAC Solutions LLC's liability for any claim arising from our services or website use is limited as follows:
- Our total liability for any claim shall not exceed the amount paid by you for the specific service that gave rise to the claim.
- We are not liable for indirect, incidental, consequential, punitive, or special damages, including lost profits, loss of use, or property damage not directly caused by our negligence.
- We are not liable for damages caused by pre-existing conditions in your HVAC system, building, or electrical system that were not disclosed to us or were not reasonably discoverable during our inspection.
- We are not liable for equipment failures or property damage caused by events beyond our control, including extreme weather, power surges, flooding, or acts of God.
10. Dispute Resolution
In the event of a dispute arising from our services or these Terms, we ask that you first contact us directly at (661) 865-1177 or joseorozcohernandez@rzchvac.com to attempt to resolve the matter informally. We are committed to resolving customer concerns fairly and promptly. If informal resolution is not possible, disputes shall be resolved through binding arbitration in Kern County, California, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
11. Applicable Law
These Terms and Conditions are governed by the laws of the State of California, without regard to conflict of law principles. Any legal proceedings arising from these Terms shall be conducted in Kern County, California. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
